Zmorda.tn does not sell vehicles directly and is never a party to any transaction between buyers and sellers. As a result, Zmorda.tn does not (a) guarantee or ensure any vehicle or any transaction between a buyer and seller, (b) collect or process payment or transfer of title on behalf of buyers or sellers, or (c) warehouse, store, ship or deliver any vehicles.

Advertisers on Zmorda.tn may include information about special offers, incentives, or pricing programs associated with a specific brand, model, or vehicle ("Offers"). Zmorda.tn is not responsible for the content of any such Offers, nor responsible for any errors or omissions in Offer contents or descriptions. You should contact the relevant advertiser for full details on any such Offers, including eligibility requirements, limitations and restrictions, and availability.

By accessing the Site and Services, you agree that Zmorda.tn is not responsible for any third party products and services information, whether such materials are accessed directly by you or used by Zmorda.tn in providing the Services, including whether third party products and services information is accurate or whether the third party products and services information is suitable for your use or use in connection with the Services. You agree that Zmorda.tn is not responsible for whether third party products and services information accessed by you is available for your use and for the performance or operation of any third party website.

Zmorda.tn does not monitor the Materials, Forums or Listing Service (collectively, “Content”) posted or transmitted by you and/or other third-party information providers. Zmorda.tn reserves the right, in its sole discretion, to review, refuse to publish, remove, delete, move or edit any Content without notice, at any time for any reason or no reason. By using the Site, you expressly agree that Zmorda.tn (a) will not be liable to any claims, actions or judgments arising out of or related to any Content and (b) may monitor, refuse to publish, remove, delete, move or edit any Content without notice at any time for any reason, without liability and without providing a refund.

Sell Terms of Service

Zmorda.tn Rules to Sell Your Car

By listing your vehicle for sale through the Zmorda.tn Sell Your Car experience, you acknowledge and agree that: (a) the vehicle you list for sale is in your possession; (b) you have the right to transfer the advertised vehicle's title to the purchaser; (c) you are willing to sell the advertised vehicle at the price and on any other terms specified in your listing; (d) you will purchase only one listing per unique vehicle and you will not advertise more than one vehicle in a single listing, either by including descriptions of multiple cars in one listing or by subsequently updating the listing information to advertise different vehicles; (e) upon selling or otherwise taking your vehicle off the market, you will within 72 hours delete the listing for that vehicle; (f) you will not use your listing to advertise or promote anything (including, without limitation, any product, service or business) other than one unique vehicle offered for sale; (g) you will owe Zmorda.tn for your Sell Your Car listing, even if you fail to sell your vehicle or are dissatisfied with the Sell Your Car experience; (h) you will properly identify yourself as either an "Individual Seller" or a "Dealer" (a "Dealer" is any individual or entity that is in the business of selling vehicles or who has had 3 or more vehicles for sale on the Zmorda.tn site within the previous 12 months of the listing start date; anyone that does not meet the definition of a Dealer is an "Individual Seller"); (j) if you placed a listing with a material error that cannot be corrected through the Zmorda.tn provided tools, you will contact Zmorda.tn customer service within 1 day of your original listing date to inquire about making material changes to your listing (e.g., through a typographical error, you listed the wrong model for sale) and Zmorda.tn shall determine, in its sole discretion, whether such changes will be permitted; (k) you will not use the Zmorda.tn site, including without limitation your Sell Your Car listing as well as any mobile versions of the Zmorda.tn site and/or any similar versions (the “Site”), for any fraudulent, false, misleading or deceptive activity; (l) all content and information that you provide to Zmorda.tn is truthful, accurate and complete; and (m) you have the full right, title and interest in and to all content, photos and other material that you provide to, or post on, Zmorda.tn; (n) photos provided for the Sell Your Car listing will only show the vehicle listed for sale and may not include under any circumstances people, animals, or other objects not part of the vehicle. Zmorda.tn reserves the right, in its sole discretion, to remove any Sell Your Car listing or photo, without notice and without liability or providing a refund, that does not meet the requirements of these Sell Your Car Terms & Conditions ("Sell Terms"), Zmorda.tn's website Terms of Service, Zmorda.tn's policies, or if Zmorda.tn otherwise determines or believes, in Zmorda.tn's sole and exclusive discretion, that your listing or any photo or other content you upload is inappropriate for any legal, business, technical or other reason.

Zmorda.tn Listing Details

Zmorda.tn Sell Your Car listings may sometimes only be created for the vehicles and models specifically identified in Build Your Ad Form (or similar) drop-down menus. You are solely responsible for the information, content, and photos contained within your Sell Your Car listings. Sell Your Car listings only contain the features expressly indicated. In some cases, different features are available to other Zmorda.tn advertisers (including but not limited to "Certified Pre-Owned" logos) that are not available to you. Zmorda.tn Sell Your Car listings may not appear on the Zmorda.tn site for up to 72 hours. Zmorda.tn DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES TO YOU REGARDING THE SELL IT YOURSELF SERVICE, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES THAT YOU WILL SELL YOUR VEHICLE, OBTAIN AN ACCEPTABLE PRICE FOR YOUR VEHICLE, ONLY RECEIVE LEGITIMATE INQUIRIES OR SOLICITATIONS FROM QUALIFIED BUYERS, OR RECEIVE ANY INQUIRIES REGARDING YOUR VEHICLE FOR SALE. Zmorda.tn reserves the right to, but is under no obligation to and does not assume any obligation to, review Sell Your Car listings before and/or after they are posted to the Zmorda.tn site to confirm information relating to the advertiser and the advertised vehicle and to investigate complaints and suspicious activity. If Zmorda.tn determines, in its sole and exclusive discretion, that you are engaging in any unfair, deceptive, false, misleading or fraudulent practices, Zmorda.tn reserves the right to reject or immediately remove your listing from the Zmorda.tn site without notice and without liability or providing a refund, as described above. Controller

Zmorda.tn and AXESAM LLC, is the operator of the Services and the data controller in the sense of the General Data Protection Regulation (GDPR). Whenever the words "we" or "our" are used in this User Privacy Notice, these refer to zmorda.tn as the data controller.

• Data on ads and data that you enter in relation to a transaction and other transaction-related content which you generate (e.g. ads, vehicle identification number and other content which you generate or which relates to your Zmorda.tn account, use of the contact function in the ads or financing enquiries, saved searches and ads).

• Information required for a financing request (in particular, for a pre-credit check) or financing brokerage (in particular, employment status, monthly net income and housing costs, any credit obligations, preferred credit period and down payment).

• Other content that you generate or that relates to your account (such as dealer ratings and comments on dealer ratings).

• Content that you share with other users through our messaging tools (see 'Filtering of messages sent via our messaging tools' under section 11).

• Financial information (e.g. credit card and account numbers, payment data) in connection with the use of a paid service offered by us or our Safe Pay feature.
